While there could be hundred reasons to why a marriage has broken down, under Singapore’s Women’s Charter, there are only 4 legally recognized reasons to divorce, called the 4 Grounds of Divorce in Singapore.

But before you consider which Ground applies to you, you have to make sure you can divorce in Singapore as there are conditions to be met before you can do so. Find out: Can I Divorce in Singapore?

Below is a summary of what each Ground means and requires:

Adultery Your partner has cheated on you and

you cannot live with your partner anymore.

Requirements:

  • You must have sufficient proof of adultery if your partner does not admit.
  • You must also not want to live with your partner anymore.

Desertion Your partner has abandoned you for at least 2 years.

Requirements:

  • The period of abandonment does not need to be consecutive.
  • Your partner has intention to bring the marriage to an end.
  • Your partner has no intention or sign of returning
  • You and your partner are living in separate households.

Separation You and your partner have lived apart for:

  1. at least 3 years (if you both agree to divorce), or
  2. for at least 4 years (if one of you does not agree to divorce)

Requirement:

  • Period of separation does not need to be consecutive.

Unreasonable Behaviour Your partner has behaved in such a way that the you cannot reasonably be expected to live with him or her anymore. Some examples include:

  • Violence
  • Constant late nights
  • Drug addiction
  • Compulsive gambling habits
  • Deprivation of sex
  • Working too many hours

Requirement:

  • You need to show that you cannot be reasonably expected to continue to live with your partner.
